Transfer of Ownership

For any materials you are donating (not sharing), you must agree to the transfer of ownership to the Santa Monica History Museum.

 

Informed Consent and Copyright Permission Form

I hereby certify that I am at least eighteen years of age (if under the age of eighteen, form must be completed by parent).

I understand that the following items may be created from my donation to the collections:

a photograph of me, an audio and / or video recording, edited audio / video clips, an edited transcript and summary, additional digital/print derivatives and/or reproductions, promotional materials, social media posts, public exhibition, sale of reproductions to support the museum as a 501(c)(3).

 

I own the personal property described in this form and desire to give said personal property to the Museum. No rights to any copyright in the Collection are being transferred to the Museum. Donor hereby grants to the museum an irrevocable perpetual royalty-free license to use and exploit the works of the Collection for which the Donor has copyright, individually or collectively for educational, not-for-profit, and for-profit purposes. This license includes the right to copy the works of the Collection or published materials for which the Donor holds copyright, collectively or individually, for educational, not-for-profit, and/or for-profit purposes in all media now known or hereafter created, including but not limited to print, audio, electronic, video, optical disc, photographic, digital and film. Without limiting the foregoing, to the extent not prohibited by copyright, the Museum is permitted to post a digital copy of the works of the Collection either collectively or individually, on the Museum websites.

I also waive any right to inspect or claim any form of remuneration for the Museum’s use of the transferred file(s) in any Museum exhibition, publication, any other form of media published by the Museum or any newspaper or other commercial media outlet.

Further, I agree to hold the Santa Monica History, its affiliates and branches harmless against any claim, action, loss, damage, or alleged infringement of any copyright, trademark, or other third party property rights, caused by or arising from the publication, exhibition, or telecast of my interview, audio and / or video recordings, photographs, or copies of my personal documents furnished to the Santa Monica History Museum as part of this program.

I understand that I shall receive no compensation for the material I share. I also understand that the material I share may not be included in the archive if it is deemed out of scope by Museum staff.
